These General Conditions of Use (CGU) govern access and use of the services. accommodation offered byACLClouds, including VPS servers, game servers (FiveM, Minecraft, Rust, ARK, Valheim, Garry's Mod), Discord bot hosting, as well as any service associate accessible via the siteaclclouds.com.

Any use of the services implies full acceptance of these T&Cs. If you do not agree to these terms, you must not use our services.

Access to ACLClouds services is open to any adult natural person or legal entity having of the necessary legal capacity. Use by minors is subject to the prior agreement of a legal representative.

ACLClouds reserves the right to refuse access to its services to any person, without obligation to justification, in particular in the event of violation of these T&Cs or behavior contrary to order public.

To access the Services, you must create an account by providing accurate, complete information and up to date. You are responsible for the confidentiality of your login credentials.

• You agree not to share your identifiers with third parties.
• Any activity carried out from your account is your responsibility.
• If your account is compromised, you must notify us immediately at[email protected].
• Only one account per natural or legal person is authorized, unless prior agreement from ACLClouds.

ACLClouds offers the following hosting services:

• Cloud VPS— Virtual private servers with AMD EPYC CPU, NVMe SSD, full root access.
• Game servers— Hosting optimized for FiveM, Minecraft (Java & Bedrock), Rust, ARK: Survival Evolved, Valheim and Garry's Mod.
• Discord bot hosting— 24/7 hosting for Node.js, Python, Go, Rust bots, Java, C#, Bun, Lua and more.

The technical characteristics, prices and availability of each service are detailed on the pages corresponding to the site. ACLClouds reserves the right to modify its offers at any time, with prior notification to the users concerned.

By using ACLClouds services, you agree to respect the following rules:

• Do not use the services for purposes that are illegal or contrary to applicable laws.
• Do not host, distribute or transmit illicit content (hateful content, child pornography, piracy, etc.).
• Do not carry out computer attacks (DDoS, brute force, port scanning, etc.) from our infrastructure.
• Do not attempt to access other customers' resources or ACLClouds infrastructure without authorization.
• Do not resell the Services without prior written consent from ACLClouds.
• Respect the intellectual property rights of third parties.
• Do not use the Services to send spam or unsolicited communications.

ACLClouds paid services are invoiced according to the prices displayed on the site at the time of subscription. Prices are indicated in euros including tax.

• Payment is due in advance for the subscribed period (monthly or otherwise).
• In the event of non-payment by the due date, ACLClouds reserves the right to suspend the service after a 48 hour grace period.
• Automatic renewals are enabled by default; you can deactivate them from your customer area.
• No refunds are granted for periods already started, except in the event of proven fault. from ACLClouds.
• Free offers are subject to manual renewal every 14 days.

ACLClouds may suspend or terminate a Service in the following cases:

• Non-compliance with these T&Cs.
• Non-payment after grace period.
• Illegal or harmful activity detected on the infrastructure.
• Request from competent authorities.

The user can cancel their service at any time from their customer area. Termination takes effective at the end of the current period. The data is kept for 7 days after termination, then permanently deleted.

ACLClouds is committed to maintaining availability of99.9% per monthfor all of its services (excluding planned maintenance).

• Planned maintenance is announced at least 24 hours in advance via email or the maintenance panel. control.
• In the event of unavailability exceeding the guaranteed SLA, compensation in the form of credits may be granted on request.
• ACLClouds cannot be held responsible for interruptions due to force majeure events. (natural disasters, operator breakdowns, etc.).

ACLClouds collects and processes your personal data in accordance with the General Protection Regulations of Data (GDPR). The data collected (name, email, IP address, billing data) is used exclusively for the provision and management of services.

ACLClouds implements all reasonable means to ensure the quality and security of its services. However, our liability is limited to direct damage and cannot exceed the amount paid by the user in the last 3 months.

ACLClouds cannot be held responsible for:

• Data loss resulting from misuse by the user.
• Indirect damage, loss of income or commercial damage.
• Content hosted by users on our infrastructures.
• Disruptions due to large-scale DDoS attacks beyond our mitigation capabilities.

It is strongly recommended to perform regular backups of your data, even if ACLClouds offers automatic backups on certain offers.

All elements of the aclclouds.com site (logo, design, texts, source code) are the property exclusive of ACLClouds and are protected by intellectual property laws. Any reproduction, even partial, is prohibited without prior written authorization.

The user retains ownership of their data and content hosted on our infrastructures. In using our services, grants ACLClouds a limited license to store and process this data for the sole purpose of providing the service.

ACLClouds reserves the right to modify these T&Cs at any time. Users will be informed of any substantial modification by email or via a notification in their customer area, with at least 15 days’ notice.

The continued use of the services after the date of entry into force of the new T&Cs is worth acceptance of these. In the event of disagreement, the user may terminate his service before the date of application.

These T&Cs are subject to French law. In the event of a dispute, the parties undertake to seek an amicable solution before any legal recourse.

In the absence of an amicable agreement, any dispute relating to the interpretation or execution of these T&Cs will be subject to the exclusive jurisdiction of the competent French courts.
